Happy 4th of July! US Supreme Court Is Moving US Democracy Towards Autocracy.

Dear Readers, Let’s not let this 4th of July, US “Independence Day” be the last time our nation celebrates being a democracy.

The July 1, 2024 US Supreme Court’s ruling that vastly expands US presidential powers, is a call for action for all of us to do our parts to fight to protect our democracy and freedoms that we’ve come to take for granted but are now in serious jeopardy. If the GOP MAGA ex-president should win, then this ruling along with the GOP MAGA Project 2025 blueprint on how his administration plans to govern will deliver the fatal blow to our US democracy.

July 1, 2024, a day that’ll go down in infamy, for it’s on this day when the US Constitution was trampled by the US Supreme Court’s six conservative justices. They granted any US president immunity from legal consequences for committing illegal acts while remotely acting in his/ her official presidential capacity. He can now act as king, a concept that was openly rejected by the US founding fathers and the authors of the US Constitution.

Make no mistake! This is a major signal that the USA is being set up to become an autocracy.

It’s up to all of us to roll up our sleeves to fight to protect our US democracy. This can’t be left to the democrat POTUS Joe Biden, alone. After all, POTUS Biden who flopped on the debate stage is the same decent and honorable man who has accomplished miracles on behalf of all Americans for the past 3 1/2 years.

Instead of democrats (supposedly anonymously), professional political pundits wasting time by calling for President Joe Biden to step down, they should be focusing on strategies to guarantee a win for democrat party candidates. Scapegoating President Biden and replacing him does not ensure a win as he was already losing in polls, pre-debate.

Yes, POTUS Joe Biden failed to gain traction with his debate nightmare, but as per recent poling, the only democrat who stands to win by 10+ points against the ex-president, is Michele Obama. Vice President Kamala Harris poll numbers are just slightly better than her boss and within the margin for error.

Meanwhile, these pundits forget that there are numerous un-doctored videos showing the felonious 78-year-old ex-president muttering, slurring words, losing his train of thought, substituting names like Obama for Biden, making non -sensical commentaries, and yet it’s only the Philadelphia Enquirer that’s called for the ex-president to step down.

Forget that there’s the 2023 New York Times published report regarding POTUS Biden’s  medical exam results, confirming that while he suffers from significant spinal arthritis, mild post-fracture foot arthritis which explains his stiffness and gastroesophageal reflux combined with seasonal allergies that cause him to frequently clear his throat, he was declared fit to successfully execute the duties of the presidency, to include those as chief executives, head of state and commander in chief.

My thoughts…

Instead of the pundits and democrats’ circular firing squad singling out POTUS Biden, where are the new ideas, strategies, tactics by Dems to utilize the Supreme Court’s ruling that dramatically expands the power of the US presidency to do something big, like eliminate the electoral college system used to select the US president?

Why isn’t the media calling for the MAGA GOP ex-president, a convicted felon, a serial sexual abuser, an insurrectionist, a wannabe dictator, who continuously spews fabrications, to step down?

Where are the military leaders talking about the MAGA ex-president’s penchant to misuse military power for personal purposes? Where are the CEOs who know what happens to businesses when executives disagree with the dictator? Just recall Florida’s Govenor DeSantis and Walt Disney.

Why aren’t voters marching in the streets like in Israel when Prime Minister Netanyahu attempted to overhaul its judiciary infrastructure?

Where are the billboards throughout the highways in swing states advertising that casting ballots for republican candidates equals voting for Russia? Where are the documentary series showing what happens to a country that is governed as an autocracy?

Have democrats turned into Zombies letting the GOP MAGA propaganda machine drive and frame the narrative because that’s what’s happening?

Here’s the key Supreme Court’s ruling on July 1, 2024, regarding presidential immunity in Trump v. United States by the conservative majority in a nutshell:

“We conclude that under our constitutional structure of separated powers, the nature of Presidential power requires that a former President have some immunity from criminal prosecution for official acts during his tenure in office. At least with respect to the President’s exercise of his core constitutional powers, this immunity must be absolute. As for his remaining official actions, he is also entitled to immunity. At the current stage of proceedings in this case, however, we need not and do not decide whether that immunity must be absolute, or instead whether a presumptive immunity is sufficient.”

As per a July 1, 2024 report by Law & Crime by Colin Kalmbacher, ‘The President is now a ‘king above the law’: Sotomayor dissent in Trump immunity case accuses majority of ‘judicial activism’ in twisted opinion that ‘has no basis in law:’

“In a molten lead dissent, Justice Sonia Sotomayor accuses the majority of generally diminishing small-R “republican” values by creating a regime where “the President is now a king above the law.” And, on the specific facts of the case where former President Donald Trump was gifted broad grants of immunity, the dissent accuses her conservative colleagues of “judicial activism, not judicial restraint.”

“With fear for our democracy, I dissent,” Sotomayor signs off — eschewing the norm of “respectfully” disagreeing with the outcome. A secondary dissent by Justice Ketanji Brown Jackson also avoids the pretense of respecting the decision in Trump v. United States.

“Today’s decision to grant former Presidents criminal immunity reshapes the institution of the Presidency,” Sotomayor begins. “It makes a mockery of the principle, foundational to our Constitution and system of Government, that no man is above the law. Relying on little more than its own misguided wisdom about the need for ‘bold and unhesitating action’ by the President, the Court gives former President Trump all the immunity he asked for and more.”

“The majority purports to keep us in suspense as to whether this immunity is absolute or presumptive, but it quickly gives up the game,” the dissent reads. “It explains that, ‘[a]t a minimum, the President must … be immune from prosecution for an official act unless the Government can show that applying a criminal prohibition to that act would pose no dangers of intrusion on the authority and functions of the Executive Branch.’ No dangers, none at all. It is hard to imagine a criminal prosecution for a President’s official acts that would pose no dangers of intrusion on Presidential authority in the majority’s eyes.”

“The President of the United States is the most powerful person in the country, and possibly the world,” the lead dissent reads. “When he uses his official powers in any way, under the majority’s reasoning, he now will be insulated from criminal prosecution. Orders the Navy’s Seal Team 6 to assassinate a political rival? Immune. Organizes a military coup to hold onto power? Immune. Takes a bribe in exchange for a pardon. Immune. Immune, immune, immune.”

“Let the President violate the law, let him exploit the trappings of his office for personal gain, let him use his official power for evil ends,” the lead dissent goes on. “Because if he knew that he may one day face liability for breaking the law, he might not be as bold and fearless as we would like him to be. That is the majority’s message today.”

The following statement is by US Congressional Representative Adam Shiff in response to the Supreme Court’s destructive ruling in Donald Trump v. United States:

“Today’s Supreme Court decision on Donald Trump’s immunity claim is far worse than anything I imagined, effectively giving a president immunity for any crimes committed while in office as long as that president can plausibly claim the action was taken in some form of official capacity. ”

“It must now be presumed that the president, as king, is immune from accountability. The rule of law applies to everyone except the most powerful person on Earth. It would be difficult to overstate how much this opinion shifts the balance of power away from Congress and towards the presidency, and how unshackled a corrupt president will now be. The Court gives the president absolute power, and it will corrupt him, absolutely.”

“As Justice Sotomayor says, this new immunity ‘now lies about like a loaded weapon’ for any President that wishes to place his own interests, his own political survival, or his own financial gain, above the interests of the Nation.

“The Court holds that when a president acts within his ‘core’ authority, he is fully immune. And when he acts outside his core authority, but in an official capacity, the presumption of immunity is so strong as to be nearly absolute. Even if he acts in a purely personal capacity, and the Court majority gives no indication of when that would be, his statements while acting officially may not be used as evidence, and his motives may not be questioned.

“Having taken up a case they never should have, having known it was the defendant’s strategy to deny justice by delaying it, the Court now remands the case for further proceedings of indeterminate length, ensuring there’ll be no accountability for Trump’s insurrectionist crimes.”

“During his abortive coup attempt, Trump told his acting attorney general and other top Justice Department officials to ‘just say that the election was corrupt and leave the rest to me and the Republican congressmen.’ Now the Supreme Court says he’s immune from ordering his Justice Department to lie, and the evidence of his malice, his very words, may not be used as evidence against him.

“Under this ruling, a president can order the assassination or jailing of their political rival and be immune. They can take a bribe in exchange for an official act, and still be immune. They can organize a military coup to hold onto power, and still be immune.”

“This is a day that will live in legal infamy. When justices on the Court that bears Roberts’ name, paid back their appointment by a corrupt president with an opinion that provides immunity to all corrupt presidents, and weakened our democracy and the rule of law for the ages.”

  2. The continual whining and hand-wringing by Democrats is counter-productive and will potentially cost us all. Time to put one lousy night behind us and move forward. There are 123 days left until election day … time to get out there and SHOW the people what Biden has and will accomplish, and SHOW them what Trump will take away from them!       It’s so maddening to watch the lying, felonious, bully of a scumbag backed by an infrastructure covering and supporting him 100% like his cult like followers, the right-wing press, GOP legislators. He’s been winning in swing states against President Biden because of the GOP political infrastructure that’s been unwavering in marching in lock step towards delivering a win for the GOP MAGA ex-president.

      Meanwhile, the political infrastructure like the press, professional political punditry has been busy devouring President Biden because he failed to deliver a knockout punch against the GOP ex-president in the recent debate. They can’t even wait for a couple of weeks for polls to see how the voters who knowingly voted in the primary elections for Joe Biden, despite him showing signs of agism.

      I truly believe in POTUS Biden’s integrity. that If he believed he couldn’t continue to serve the best interests of all Americans, he’d step down. After 50+ years of admirable public service, he deserves the benefit of the doubt.

      I hope congratulations are in order for the recent election results, across the pond.

      It’s my contention that the professional political infrastructure politicians and news editorial pundits are cowards in that they were relying on President Biden to deliver a knockout punch against a lying, felonious, rule breaking professional TV reality personality who has made roadkill against numerous opponents on the debate stage and who wasn’t bound by any evidentiary burdens by the debate moderators.

      And when this decent leader who has accomplished tremendous things for this country despite his age and having to overcome great opposition for the last 3 1/2 years, is being thrown under the bus because of his lousy debate performance.

      These same back seat drivers would have fared no better on the debate stage against the ex-president. They should be ashamed.

        The British system based on who wins the largest number of parliamentary constituency seats in turn based on who wins the most votes in a constituency sometimes gives rise to quirks. In this case.
        1. Labour’s share of the vote barely changed and yet they won 211 seats.
        2. The far right Reform party polled some 4,000,000 votes yet only have 4 seats, whereas the Liberal-Democrats who polled approx 3,900,000 votes won 71 seats.
        Tactical voting seems to have won the day.
        I’ll have to write a post on this.

        The ‘Biden’ performance does seem to concentrate more on style than substance. Regrettably it seems there is a large section of the American public and media who use the same judgement for politics as they do for TV talent and ‘unReality’ shows.

        This does remind me of the reaction to the JFK / Nixon debate as seen by the TV viewing public; apparently when the radio audience were polled they came out in favour of Nixon.

  4. The Ballot box is no longer the only remedy. Scotus have ensured the Prsidential immunity which must now apply to Joe Biden. He could order a hit squad to take out Trump and arrest all the billionaire backers as well as the architects of Project 2025 and as they’re all done under Prsidential Powers for the protection of the USA he can’t be touched. What’s good for the Goose………..

    • President Biden is a decent and humble man, he’ll never “order the hit” like his opponent whose name shall never be spoken. That’s why America needs him more than ever, and not a mafia don with an oversized ego and peanut for brains. It’s a compelling fantasy I have to admit, but devolving into your own worst enemy is not the way to go. 😉

        You’re right in that POTUS Biden can be counted to not abuse his presidential powers. If the political infrastructure gets behind him or any other democrat if he steps down, then the democrat party’s presidential candidate will win.

        It’s my intent to vote for any democratic party’s presidential candidate or any candidate who is a staunch supporter of protecting our US democracy.

  5. Gronda, well written. Next month is the 50th anniversary of the resignation of Richard Nixon, before he was impeached and convicted by Congress. It was one of the finest moments in US history where Congress held a president accountable for his crimes. Nixon famously said “I am not a crook.” He was.

    With the scotus ruling fifty years later, would he be pressured to resign? We have to remember what Nixon did the October before called “the Saturday massacre,” when he ordered two people to fire the prosecutors on the case and they refused, until he got a third stooge named Robert Bork to do so. Americans, look up the named Archibald Cox, Elliott Richardson and William Ruckleshaus who should be well remembered.

    People later tried to white-wash what Nixon did, but two dozen of his staff went to jail including his top two aides and Attorney General. I mention this as what Donald J. Trump has done is far worse in magnitude and volume than what Nixon did. Trump and his sycophants say Trump has done nothing wrong. Really? Not a thing?

    Fraud? Sedition? Election meddling? Serial sexual assault? Defamation? Classified document mishandling? Purposeful dividing of America? Botching the pandemic response? Screwing up the first travel ban so badly it was pulled after two days? Nothing wrong?

    We the people have to hold our elected officials accountable, including the president. The scotus truly got this ruling crowd. And, while we are at it, I don’t care for a scotus associate justice taking numerous bribes.

        The old GOP party elders did the right thing by holding President Nixon, accountable. At no point, was he given reign to believe that he was beyond the law.

        But all that has changed. Today, President Nixon would have gotten away with his criminal activity.

        Here we are, with many calling for a decent man, POTUS Biden who has admirably served this country for 50+ years and who’s done an exceptional job on the foreign stage and for managing the US economic recovery, post COVID, to step down after an admittedly poor showing at the last debate. He deserves the space, chance to prove that he’s up to the job of president.

        The MAGA GOP ex-president has pummeled past GOP opponents on the debate stage. He’s never been incumbered by evidentiary burdens, and so, as a professional TV reality performer keeps winning as he gets a free pass in making false assertions against his opponents, bullying those who he feels have slighted him, fabricating accomplishments, etc. Yet, the GOP political infrastructure has been unwavering in their support.

        I worry that military and business leaders aren’t speaking out more aggressively against the ex-president out of fear. This includes media executives who have been highly focused on POTUS Biden’s debate fubar while not holding the ex-president to the same standard.
