US Courts To The Rescue: Federal Judge Ruled That The DACA Program Must Be Reinstated

How about some good news for a change. This one’s a doozy. A US federal court judge has ruled that the DACA program started under the Democratic President Barack Obama must be continued. The republican President Donald Trump is barred from ending it outright.

The DACA (Deferred Deferred Childhood Arrivals) program was instituted to prevent the deportation of young adults who came to the USA as children with undocumented parents but, they no longer know their country of origin.

“A federal judge ruled Friday that the Trump administration must fully restore the Deferred Action for Childhood Arrivals (DACA) program.

“In his 25-page opinion, Judge John Bates said the Trump  White House had again failed to provide justification for its proposal to end the Obama-era program, under which nearly 800,000 people brought to the country illegally as children, known as “Dreamers,” have received work permits and deferral from deportation.”

“The judge also said in his opinion that he has agreed to delay his ruling to give the Trump administration 20 days “to determine whether it intends to appeal the Court’s decision and, if so, to seek a stay pending appeal.”

“President Trump rescinded DACA in September, a decision Bates wrote in his opinion “was arbitrary and capricious” with legal judgment that was “inadequately explained.”

“Bates further wrote that the U.S. District Court for the District of Columbia holds that if the Trump administration wishes to rescind the program, or take any other action for that matter, it must “give a rational explanation for its decision.”

“Bates said his court reaffirms its conclusion that DACA’s rescission “was unlawful and must be set aside.”

“Earlier this year, Bates, a George W. Bush appointee, became the third federal judge to reject Trump’s explanation for ending the program, ruling at the time that the decision by the Justice Department that the program was unlawful was “virtually unexplained.”

“(This is after President) Trump has faced backlash for his controversial “zero-tolerance” at the Mexican border, which prioritizes the prosecutions of migrants who illegally enter the United States.”

“The policy led to the separation of hundreds of migrant children from their parents, causing a bipartisan uproar. A court previously ordered the government to reunite the migrant families by last Thursday, but hundreds of children still remain divided from their parents.”

      You are so right. Many of these judges ruling against President Trump were appointed under the republican President George Bush’s which makes this even more daunting for him.

      So far, the courts have been the one pillar of our democracy that has been a true check on power run amok.

  1. Gronda, what the US President fails to realize, is DACA was passed due to Congress’ failure to act on immigration. Three Senate bipartisan efforts (two of which passed) were never discussed by the House. Even Trump waylaid a bipartisan effort by stabbing its dealmskers in the back after agreeing to it in the morning.

    Repiblican leaders will breath easier as they again won’t have to address this issue. But, there is always the man Witt the fragile ego, who wants to diminish anything Obama did irrespective of its veracity. He will react as only he can. Keith

      President Obama was not like our current one. Before he acted, there was lots of deliberation, respect for the “rule of law,” etc.

      President Trump’s priority in to cater to his base, his anti-immigration base. But in this case, the smart move would be for him to accept this ruling but he is not known for being a deliberate kind of thinker.

  2. You can bet he is already looking for a way around this ruling. If you cannot convince a judge why you are doing somesthing, Deny, Distract, Speechify. Only billionaires should be allowed to live in the USA. Give him his way, move out, and let jim see who collects his trash and cleans his toilets. Does he even wipe his own butt? I doubt it…

      He is the only one in America who has to show his ID before purchasing groceries. This is the line he used to justify the requirement for voter IDs.

      I am so looking forward to him losing on this one.

      But you are right in your thinking. He will be yelling and screaming away at his team to figure out a way around this ruling.
